By accessing and using Optimi's MVP platform (the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

Optimi is an AI-powered conversion rate optimization platform that provides the following features:
Website audits to identify conversion opportunities

Voice of customer analysis
Market and competitor analysis
Funnel strategy recommendations
3. User Data and Privacy
You retain full ownership of any data or content you input into the platform.
We do not claim any rights to your website data, content, or recommendations generated by the Service.
Your use of the Service is also governed by our Privacy Policy.
4. AI Disclaimers and No Warranties
The Service uses AI to generate recommendations, content, and insights. AI may make mistakes, produce inaccurate information, or hallucinate content.

Acting on AI-generated recommendations
Implementing suggestions from the platform
Users must exercise judgment and caution when applying recommendations. You are solely responsible for changes made to your website or marketing based on insights from Optimi.
6. Intellectual Property
Optimi owns all rights, title, and interest in the Service, including software, technology, and intellectual property.
You are granted a limited, non-exclusive right to use the Service for its intended purpose.
You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Service Availability
While we strive to maintain platform availability, we make no guarantees regarding uptime. Service interruptions may occur due to maintenance, updates, or technical issues.
9. Dispute Resolution
Any disputes arising from your use of the Service should be directed to kim@optimi.studio. We will attempt to resolve disputes through good faith communication.
10. Governing Law
These Terms and Conditions are governed by the laws of Queensland, Australia. Any legal proceedings must be conducted in the appropriate courts of Queensland, Australia.
11. Changes to Terms
We may update these Terms and Conditions at any time by posting revised terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the new terms.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Eligibility
This guarantee applies only to users who have:
a. Generated website copy or recommendations using Optimi’s AI tools, and
b. Implemented the suggested content or changes on their live website, and

Measurement Criteria
“Conversion rate” refers to the percentage of visitors who complete a desired action (e.g., purchase, form submission, booking, or lead capture) as measured consistently before and after Optimi implementation.
The uplift percentage is calculated based on the same traffic sources and conversion goals to ensure a fair comparison.
Claim Process
To request a refund, you must submit:
Evidence of your baseline conversion data (pre-Optimi), and
Post-implementation conversion data showing no uplift of at least 20%, and
Confirmation that Optimi-generated content was implemented as provided.
Claims must be submitted within 90 days of the purchase date.
Exclusions
The guarantee does not apply if:
Content or recommendations were drastically edited or rewritten, or only partially implemented.
The website experienced significant changes outside of Optimi’s recommendations (e.g., new design, traffic source change, tracking setup errors, or third-party interference).
Conversion tracking data is incomplete, inaccurate, or unavailable.
Refund Process
Approved refunds will be processed to the original payment method within 14 business days of verification.
Fair Use
